Agreeing to these terms

These terms apply when you use the Heartland Boston Concrete Company website, ask us for an estimate or hire us for concrete work. By using the site or booking a job with us, you agree to them. If you don't agree, please don't use the site or book work with us.

In these terms, "we," "us" and "our" mean Heartland Boston Concrete Company, and "you" means the person using the site or hiring us.

What we do

We're a concrete contractor in Boston, MA. We build driveways, patios, sidewalks, steps, garage floors, foundations, footings, retaining walls and other concrete work for homes and businesses in Boston and the cities around it. You'll find the full list of services on our home page, and you can read about our crew on the About page.

The information on this site is general. It describes the kind of work we do and how we usually do it, but every job is different. The written estimate or agreement for your job sets out what we'll actually do, and if the site and that agreement say different things, the written agreement controls.

Estimates and pricing

Estimates are free and done in person, because we need to see the ground, the old concrete and where the water runs before we can price the work honestly. There's no pressure to book.

An estimate is based on what we can see that day. It covers the work, materials and price written in it, for as long as it says it's valid. If we find something once the job is open that we couldn't see before, such as soft or wet ground under an old slab, buried debris, roots or old concrete thicker than expected, we'll stop, show you and agree on any change in writing before we do extra work at extra cost.

The price on an estimate doesn't include work the estimate doesn't list. Changes you ask for after booking, like a bigger area, a different finish or added steps, are priced separately and agreed in writing before we do them.

Scheduling, weather and cancellation

We'll give you a start date when you book, and we work to keep it. Concrete depends on the weather, so rain, freezing temperatures, high heat, supplier delays or ground conditions can push a pour back. When that happens, we'll tell you as soon as we know and set a new date with you. We aren't responsible for costs caused by delays outside our control.

New concrete needs time to cure, which is the wait while it hardens and gains strength before it can take weight. We'll tell you when it's safe to walk on and when it's safe to drive on. Damage from using it sooner, or from people, pets, vehicles or equipment we don't control, isn't our responsibility.

If you need to cancel or reschedule, call us at (857) 770-0722 as early as you can. If we've already ordered materials, booked a concrete delivery or started work, you may owe for those costs and the work done up to that point, as your agreement states.

Payment

Your written estimate or agreement sets out the payment terms, including any deposit and when the balance is due. Unless it says otherwise, the balance is due when the work is finished.

If a payment is late, we may pause the work until it's paid. You'll also be responsible for the reasonable costs of collecting what's owed, to the extent Massachusetts law allows.

What we need from you

You agree to give our crew safe access to the work area and to confirm you have the right to have the work done on the property. Please tell us about anything we can't see, such as unmarked underground lines, sprinkler pipes, drains or questions about where the property line is.

Please move vehicles, furniture and anything else out of the work area before we arrive. Whether your job needs a permit depends on your city and the work, and the written agreement for your job will say who is responsible for any permit it needs.

Our work and what we don't promise

We're licensed and insured, and we stand behind the work we do. Any warranty on your job is the one written in your agreement, and it covers only what it says.

Concrete is a natural material, so some things aren't defects. Hairline cracks can show up as a slab shrinks, which is why we cut control joints, the grooves that give those cracks a planned place to form. Color can vary between pours and between new and old concrete, and any finish wears with use.

We don't warrant damage from things outside our control, such as ground movement, frost, flooding, drainage we didn't build, tree roots, vehicles or equipment heavier than the slab was built for, de-icing salt on new concrete, or repairs and changes made by others. Apart from any warranty written in your agreement, and to the extent the law allows, our website and services come without other warranties of any kind.

Limits on our liability

To the extent Massachusetts law allows, Heartland Boston Concrete Company isn't liable for indirect, incidental or consequential losses, such as lost use of a driveway, lost income or the cost of other arrangements while work is delayed or the concrete cures. Our total liability for any claim about a job is limited to the amount you paid us for that job.

Nothing in these terms limits a right you have that the law doesn't allow us to limit.

Using this website

The text, photos and other content on this site belong to Heartland Boston Concrete Company or are used with permission. You're welcome to view and share pages for personal use, but please don't copy them for commercial use without our written permission.

We try to keep the site accurate and up to date, but we don't promise it's free of errors or always available. Some parts, like our contact form, run on services provided by others, and we aren't responsible for the content or practices of outside websites.

If something goes wrong

If something isn't right with your job, call us first, because most problems get sorted out quickly once we come out and look at it with you. If we can't settle it that way, we both agree to try in good faith to resolve it through mediation before going to court, unless the dispute belongs in small claims court.

Which law applies

These terms and any agreement for work with us are governed by the laws of the Commonwealth of Massachusetts. Any court case about them will be brought in the Massachusetts state courts, unless the law requires otherwise.

Changes to these terms

We may update these terms from time to time, and changes take effect when they're posted on this page. The version in place when you book a job applies to that job, and using the site after a change means you accept the updated terms.

If any part of these terms can't be enforced, the rest still applies.
